Eligibility
Gopher Wit is open only to Legal Residents of
the 50 United States and the District of Columbia
and maintains residency throughout the game period.
Potential winners may be required to provide proof
of legal U.S. residency if requested by Gopher
Wit to determine eligibility and as a condition
of prize award. To become a member of Gopher Wit
or play any of the games you must be 18 years
of age or older at the time of a games start date
and have a valid U.S. Social Security Number and
will be responsible for any taxes. Potential winners
may be required to provide proof of age and a
valid U.S. Social Security Number. Employees of
Gopher Wit, its respective parents, affiliates,
subsidiaries, divisions, suppliers, distributors,
advertising, promotion and internal agencies and
their immediate family members and/or those living
in the same household of each (whether related
or not) are not eligible. All federal, state and
local laws and regulations apply. Void where prohibited
by law.
Members Releases
All members, as a condition of entry into www.gogherwit.com
(the Web Site), agree to release Gopher Wit, its
respective parents, affiliates, subsidiaries,
divisions, suppliers, distributors, advertising,
promotion and internal agencies from and against
any and all liability, claims or actions of any
kind whatsoever for injuries, damages, or losses
to persons or property which may be sustained
in connection with: accessing the Web Site or
other web sites; submitting an membership or otherwise
participating in any aspect of the game; the receipt,
ownership or use of any prize awarded; or any
typographical or other error(s) in these Official
Rules or the announcement of offering of any prize.
Members understand that Gopher Wit does not sell
any product or service or charge any fees to their
Members. The Web Site is for Members entertainment
and viewing pleasure. The Web Site “IS NOT”
offered as a game of luck and/or chance but “IS”
a game that requires knowledge, reasoning, physical
abilities and possible travel. Any expenses, loses
or damages while playing any game are deemed to
be of the Member’s own freewill and is the
sole responsibility of the member and is not as
a result of and/or anyway the responsibility of
the sponsor its respective parents, affiliates,
subsidiaries, divisions, suppliers, distributors,
advertising, promotion and internal agencies.
Games shall be constructed and evaluated according
to the laws of each state that the prize is presented
and/or redeemed. Void where prohibited.
Conduct
By becoming a member of Gopher Wit, Members agree
to be bound by the Official Rules and the decisions
of the Sponsor that shall be final and binding
in all respects. Failure to comply with these
Official Rules may result in disqualification.
Sponsor reserves the right at its sole discretion
to disqualify, prohibit the participation of any
individual suspected of tampering, fraud or fails
to comply with any requirement of participation
as stated herein or with the operation of the
game or the Web Site; or to be acting in any manner
deemed by the Sponsor to be in violation of any
provision of the Official Rules; or to be acting
in any manner deemed by the Sponsor to be unsportsmanlike
or disruptive, or with intent to annoy, abuse,
threaten or harass any other person.
Set Up Agreement
The name of the person submitting the email address
upon entry must be the name of the authorized
account holder of such email address, otherwise,
entry may be deemed void. In the event of dispute
over the identity of a potential winner, it will
be declared that the authorized account holder
of the email address submitted at the time of
setting up of the Gopher Wit membership will be
deemed the account holder. The potential winner
may be required to provide identification sufficient
to show that he/she is the authorized account
holder of such email address.
General
Members agree to release, discharge and hold harmless
Sponsor, its respective directors, officers, employees
and assigns, from and against any and all liability
and damages. By participating in a game the Member
agrees to be bound by the Official Rules and the
judges' decisions which are final. In the event
there is a discrepancy or inconsistency between
disclosures or other statements contained in any
promotional materials and the terms and conditions
of the Official Rules, the Official Rules shall
prevail, govern and control. Sponsor is not responsible
for any typographical or other error(s) in the
printing of the offer administration of the promotion
or in the announcement of the prize. In any event
will more than the stated number of prizes be
awarded. Potential winners will be required to
complete an Affidavit of Eligibility certifying
that the Official Rules were followed. Additionally,
potential winner will be required to complete
a Release of Liability, Prize Acceptance Form
and if legally permissible, a Liability Release.
All forms must be received within 10 days of attempted
notification. Noncompliance within this time period
will result in disqualification and the next potential
winner would have to qualify.
Winners
All potential prize winners must be a member of
Gopher Wit and proof of membership will be verified
by the Sponsor. By accepting prize, winner agrees
to release and does not hold Sponsor, its respective
directors, officers, employees and assigns, from
against any and all claims and liability arising
out of use of prize and agrees to signs a harmless
from. Winner assumes all liability for any injury
or damage caused or claimed to be caused by participation
in this game or use or redemption of any prize.
Prizes will be awarded and/or delivered only to
addresses within the United States. Any prize
is awarded "as is" and without warranty
of any kind, expressed or implied, except as provided
by the manufacturer. The winner shall bear all
risk of loss or damage to their prize after it
has been delivered. Gopher Wit makes no representations
or warranties of any kind concerning the appearance,
safety or performance of any prize. Except as
determined by Sponsor in its sole discretion,
no substitution of prize is offered, no transfer
of prize to a third party is permitted, and non-cash
prizes may not be redeemed for cash value. Any
difference between stated approximate value of
prize and actual value of prize will not be awarded.
Prize winners will be solely responsible for all
applicable federal, state and local taxes on prize.
Winner may receive an IRS Form 1099 for the retail
value of the prize. All other expenses on the
receipt and use of a prize not specifically mentioned
herein are solely the responsibility of the winner.
Any portion of a prize not accepted by winner
will be forfeited. Winners will be required to
provide all appropriate documents to Gopher Wit
for tax purposes such as, but not limited to,
valid Social Security Number and ID for any taxes.
Acceptance of prize construes permission for the
Sponsor and its agencies to use winner's name,
address, voice, statement, picture, and trade
the right to print, publish, broadcast and use
worldwide, in any media now known or hereinafter
known (including without limitation use online
at the Web Site) and/or likeness for purposes
of advertising, promotional and public relations
as determined by Gopher Wit without further and/or
additional compensation, unless prohibited by
law. Winner(s) must sit out the next game (whether
in progress or not) and is not eligible until
the next game or one year which ever time period
is shorter.
Limitations of Liability
Gopher Wit assumes no responsibility or liability
for (a) any incorrect or inaccurate entry information,
any faulty, incorrect or miss-transcribed phone
transmissions, incorrect announcements of any
kind, technical hardware or software failures
of any kind including any injury or damage to
any person's computer related to or resulting
from participating in or experiencing any materials
in connection with the game, lost or unavailable
network connections, or failed, incomplete, garbled
or delayed computer transmission that may limit
a user's ability to participate in the game. (b)
any unauthorized access to, or theft, destruction
or alteration of entries at any point in the operation
of this game; (c) any technical malfunction, failure,
error, omission, interruption, deletion, defect,
delay in operation or communications line failure,
regardless of cause, with regard to any equipment,
systems, networks, lines, satellites, servers,
computers or providers utilized in any aspect
of the operation of the game; (d) inaccessibility
or unavailability of the Internet or the Web Site
or any combination thereof, or; (e) any injury
or damage to participant's or to any other person's
computer which may be related to or resulting
from any attempt to participate in the game or
download any materials in the game. If, for any
reason, the game is not capable of running as
planned for reasons which may include without
limitation, infection by computer virus, bugs,
tampering, unauthorized intervention, fraud, technical
failures, or any other causes which may corrupt
or affect the administration, security, fairness,
integrity or proper conduct of this game, then
Sponsor reserves the right at its sole discretion
to cancel, terminate, modify or suspend the game
in whole or in part. In the event of any of these
issues a notice will be posted online to view
for game status.
Notice of Warning
Attempt by any Member (The authorized e-mail account
holder of the e-mail address submitted at the
time of entry.) or any other individual to deliberately
damage any web site, undermine the legitimate
operation of this game is a violation of criminal
and civil laws and should such an attempt be made,
sponsor reserves the right to seek damages and
costs (including without limitation, attorneys'
fees) from any such individual to the fullest
extent permitted by law.
